This is a courtesy translation. The offer is made in Russian under the law of the Republic of Kazakhstan, and the Russian text prevails in case of any discrepancy.
This document is a public offer by the sole proprietor "Tanym" (the Seller) and sets out every material term of the agreement for the Tomi service.
Under articles 395 and 396 of the Civil Code of the Republic of Kazakhstan, paying for any credit package is full and unconditional acceptance of this offer and concludes the agreement on the terms below. If you do not agree with any term, do not pay.
The Seller provides access to the Tomi software service and sells prepaid units of use — credits. Credits are spent on tasks the Buyer sets: the service places an outbound telephone call on the Buyer’s behalf and returns a transcript and a report.
The Seller is not a telecommunications carrier and provides no telecommunications services. Call connectivity is supplied by licensed telecommunications platforms engaged by the Seller; the subject of this agreement is the software service and its use.
Every call is initiated by the Buyer and opens with a mandatory spoken disclosure that the caller is an artificial intelligence acting on the Buyer’s behalf. This disclosure cannot be switched off.
Acceptance is payment for a credit package on /ar/topup. The agreement is concluded when the payment is credited, and its terms are accepted in full.
By accepting, the Buyer confirms they are of an age at which they may enter into such agreements on their own behalf, and act in their own interest.
Package prices are shown on /ar/topup. For cards issued in the Republic of Kazakhstan the price is quoted and charged in tenge, and the amount charged is the amount shown on the page at the time of payment.
Payment is made in one instalment through a payment service. Card details are entered on the payment organisation’s secure page; they are neither passed to nor stored by the Seller.
The Seller may change prices. A change does not affect credits already paid for and credited.
Credits are added to the Buyer’s balance automatically once the payment organisation confirms payment, normally within minutes. As regards the sale of credits, the service is delivered when they reach the balance.
Credits are spent as tasks run. If a call does not happen (no answer, busy line and the like), the reserved credits return to the balance automatically: the Buyer pays only for calls that took place.
Credits do not expire. New accounts get a free allowance to try the service; its current size is shown on /ar/topup and may be changed by the Seller.
A refund of an unused credit balance may be requested within 14 (fourteen) calendar days of purchase by writing to support@tomi.tel. Refunds are returned to the card used for payment.
Credits already spent on completed tasks are not refundable — that part of the service has been delivered.
The full refund terms are set out on /ar/refunds and form an integral part of this agreement.
The Buyer undertakes not to use the service for calls that are unlawful, fraudulent, harassing or misleading beyond the mandatory AI disclosure, nor to impersonate a specific real person without their consent, nor for bulk or automated cold-calling.
Calls are recorded and transcribed to produce the report. Recording law differs between jurisdictions and some require the consent of every participant. By ordering a call the Buyer warrants that recording it is lawful in the jurisdictions involved, including the destination country, and bears sole responsibility for this.
The Seller may refuse or cancel any task that breaches this clause. The full rules of use are on /ar/terms.
The service is provided on a best-efforts basis. The Seller does not guarantee that a call will be answered, that the other party will understand the task, or that the call will produce the outcome the Buyer wanted, and is not responsible for the acts, answers or decisions of the third parties called.
The Seller’s liability under this agreement is in any event limited to the value of the credits spent on the task giving rise to the claim.
By accepting this offer the Buyer consents to the collection and processing of personal data to the extent and on the terms set out in the privacy policy on /ar/privacy, which forms an integral part of this agreement.
The agreement runs from acceptance until both parties have performed their obligations. It is governed by the law of the Republic of Kazakhstan; disputes not settled by negotiation are heard by the courts of the Republic of Kazakhstan at the Seller’s location.
The Seller may amend this offer. A new version takes effect when published on this page and does not apply retroactively to transactions already concluded and performed. The date of the last change is shown at the top of the page.
